1. Acceptance of Terms

Welcome to mkquilts.com (the "Site"), owned and operated by MK Quilts LLC ("MK Quilts," "we," "us," or "our"). By accessing or using the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

2. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, products, or legal requirements. When we do, we will revise the "Last updated" date above. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

3. Eligibility

You must be at least 18 years old, or the age of majority in your state, to make a purchase on the Site. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian.

4. Products, Descriptions & Pricing

We make every effort to display our fabrics, patterns, kits, and notions as accurately as possible, including colors, yardage, and descriptions. However, colors may vary slightly depending on your device's display, and dye lots for fabric can vary between bolts. We do not guarantee that product descriptions or other content on the Site are entirely accurate, complete, or error-free.

All prices are listed in U.S. dollars and are subject to change without notice. In the event a product is listed at an incorrect price due to a typographical, pricing, or technical error, we reserve the right to cancel any orders placed for that product, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged for a canceled order, we will issue a refund.

5. Orders & Payment

By placing an order, you are making an offer to purchase the product(s) in your cart. We reserve the right to accept or decline any order for any reason, including suspected fraud, errors in pricing or product information, or limited stock (which can happen with cut fabric and one-of-a-kind items).

Payment is due in full at the time of order. We accept the payment methods indicated at checkout. You represent that you are authorized to use the payment method provided. Applicable sales tax will be added to orders shipped to states where we are required to collect it.

6. Shipping & Delivery

Orders are typically processed within 1 business day, excluding weekends and holidays. Shipping times are estimates provided by our carriers and are not guaranteed. Risk of loss and title for items purchased pass to you upon our delivery to the shipping carrier. We are not responsible for delays, loss, or damage caused by the shipping carrier once a package has left our shop, though we're happy to help you file a claim if this happens.

7. Returns, Refunds & Exchanges

Because of the nature of our products, our return policy varies by item type:

•       Patterns, quilt kits, and digital products are final sale and are not eligible for return, refund, or exchange, once purchased due to copyright laws.

•       Cut fabric (fabric cut to your specified yardage) is custom-cut for you and is generally not eligible for return unless it arrives defective or is not what you ordered. Fabric must be returned in its original condition and will be measured to ensure it returns the same length.

•       Notions, tools, and other unopened, unused merchandise may be returned within 30 days of purchase with proof of purchase, in original, unused, and resalable condition.

If you receive an item that is damaged, defective, or incorrect, please contact us at support@mkquilts.com within 30 days of receipt so we can make it right.

8. Order Cancellations

You may request to cancel an order before it has shipped by contacting us as soon as possible. Once an order has shipped or fabric has been cut to fulfill it, we may not be able to cancel it.

9. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, and the MK Quilts name and branding — is owned by or licensed to MK Quilts LLC and is protected by copyright and trademark law.

Quilt patterns, kits, and digital downloads sold through the Site are licensed to you for personal, non-commercial use only. Unless a specific pattern states otherwise, you may not photocopy, scan, digitally reproduce, resell, teach from for compensation, or use these patterns or designs to manufacture finished items for commercial sale, without our express written permission.

10. User Accounts

If the Site allows you to create an account, you are responsible for maintaining the confidentiality of your login information and for all activity under your account. Please notify us immediately of any unauthorized use of your account.

MK Quilts LLC does not store or have access to your credit card or other payment information. Payments are processed through our Shopify-powered checkout, which may retain payment details in accordance with its own security and privacy practices.

11. Prohibited Uses

You agree not to use the Site to: violate any applicable law; infringe our or any third party's intellectual property rights; transmit viruses or harmful code; attempt to gain unauthorized access to the Site or its systems; or interfere with the proper functioning of the Site.

12. Third-Party Links

The Site may contain links to third-party websites (such as social media or payment processors) that are not owned or controlled by MK Quilts LLC. We are not responsible for the content, policies, or practices of any third-party sites.

13. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available," without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free.

14. Limitation of Liability

To the fullest extent permitted by law, MK Quilts LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the product(s) giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless MK Quilts LLC, its owners, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Site.

16. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MK Quilts LLC regarding your use of the Site.
